SANTA ANA, CA, and DALLAS (January 27, 2025) -- Buether Joe & Counselors, LLC is pleased to announce that a team of Firm lawyers secured a victory in the U.S. District Court for the Central District of California, Santa Ana Division for client Kendon Industries, LLC against Towblazer, Inc. and Troy E. Shockley in a case involving breach of a 2007 settlement agreement which had resolved patent litigation between the parties in 2005.
Following a four-day trial, a federal jury found that Towblazer and Shockley breached the settlement agreement by selling foldable, stand-up motorcycle and ATV trailers between April 2019 and November 2023, which sales were prohibited by the settlement agreement.
The jury awarded damages of $1,803,000 to Kendon.
In addition to the jury's finding Towblazer and Shockley responsible for damages for breach of the settlement agreement, the jury's verdict allows for additional relief, including pre-judgment interest and legal costs and fees incurred in bringing the claim which Kendon and BJC will be pursuing through post-judgment motions.
